Comprehensive birth doula support including two (2) prenatal preparation visits (in-home or virtual), continuous physical and emotional labor support from active labor through immediate postpartum recovery, 24/7 on-call availability starting at 37 weeks gestation, and one (1) in-home postpartum follow-up visit within 14 days of birth.
Contract Terms & Legal Provisions
1. Scope of Services & Deliverables
The Doula agrees to provide non-medical labor support as outlined above. The Doula will provide continuous in-person support during active labor and birth, and stay for 1 to 2 hours following delivery to support initial infant feeding and parent bonding.
2. 24/7 On-Call Availability & Notification
The Doula is officially on-call 24 hours a day, 7 days a week starting at 37 weeks gestation until delivery. The Client agrees to notify the Doula of all signs of early labor, provider updates, and when departing for the birth place. The Doula requires approximately 1 to 2 hours travel time upon request to attend.
3. Financial Terms, Retainer & Milestone Balance
The total fee for services is agreed upon signing. A non-refundable retainer is required to reserve the Client's estimated birth window. The remaining balance must be paid in full by 36 weeks gestation. If payment is not completed by 36 weeks, on-call services may be suspended.
4. Scope of Practice & Non-Medical Disclaimer
The Doula provides emotional, physical, and informational support only. The Doula is NOT a healthcare provider and will not perform clinical assessments (e.g., cervical exams, fetal heart monitoring, blood pressure checks), prescribe medications, or make medical decisions on behalf of the Client. All clinical care remains the sole responsibility of the Client's licensed medical team (OB/GYN, Midwife, Hospital Staff).
5. Backup Doula Protocol
In the unlikely event of doula illness, injury, sudden emergency, or overlapping births, a qualified backup doula will be assigned to attend the Client's birth. The Doula will handle backup compensation directly at no additional cost to the Client.
6. Hospital & Facility Visitor Restrictions
If hospital or facility policies restrict doula attendance at the time of birth, the Doula will provide continuous virtual labor support (phone, video, text) and substitute unused in-person hours with postpartum daytime visits upon return home.
If the birth occurs rapidly (precipitous labor) before the Doula arrives despite timely notification by the Client, or in the event of an unplanned emergency Cesarean, the Doula will provide immediate postpartum hospital support and add two (2) complimentary in-home postpartum sessions. Retainers are strictly non-refundable.
By executing this agreement, both parties confirm their mutual understanding and acceptance of all terms, policies, and non-medical limits.

Specialized doula agreement templates
Different perinatal specialties require distinct legal terms, shift boundaries, and payment schedules. Explore our dedicated templates tailored to specific scopes of practice:
To ensure your agreement holds up and provides genuine protection, make sure your contract includes these four foundational pillars:
Non-refundable retainer & 36-week balance: A 30% to 50% non-refundable retainer holds the birth window on your calendar. Setting the remaining balance due at 36 weeks ensures your compensation is settled before active labor begins.
24/7 On-Call window definition: Clearly state that you are on-call starting at 37 weeks gestation until delivery, and specify your expected travel response time upon notification.
Non-medical scope of practice disclaimer: Protect your liability by explicitly stating that doulas provide physical, emotional, and informational support, and do not perform clinical exams or provide medical diagnoses.
Backup doula protocol: Explain how backup coverage works if you are ill or attending another birth, reassuring families that they will always have continuous support.
